Along
with the documents of the Expression
of Interest, the following documents
and information must be presented
for the Legal Qualification:
»A
notarized complete copy of the Articles
of Incorporation and By-laws of the
applicant Company registered with
the Business Registry (or equivalent
competent body) in the place of incorporation;
and
»
An express declaration by the Company’s
Accredited Representative that there
are no pending litigation, legal proceedings
or other circumstances which may lead
to the failure or bankruptcy of the
Company.
Participants from other countries
should present, along with the documents
listed above, the following:
»Proof
that the Company is legally constituted,
organized and functions according
to the laws of its home country;
»An
undertaking that, in the event the
Company is successful in the bidding,
it will constitute a company with
its headquarters and management in
Brazil according to Brazilian laws.
Notarization requirements may be obtained
at the Initial Tender Protocol.
